Appeals Court: Yearning For Zion children taken unconstitutionally

Its not fun to argue in favor of polygamist’s.  If fact, I find their whole compound and lifestyle disturbing. But that does not deter the fact that in this case the constitution requires our attention. I am sure many of them would find things in my lifestyle disturbing.

Quite simply, the State of Texas fabricated a “victim” as an excuse act on a “hunch” of child abuse.

Now and Appeals Court has agreed with what many knew all along: that the procedure the constitution requires for executing a search warrant and seizing property/children was not followed in this case.

Hmmm… what a shock. You mean you can’t rip children away from 300+ families because one child in one family on the compound was being supposedly abused? Never mind the fact that the supposed victim doesn’t exist in this case. It is just plain common sense that the rule of law would have to be applied in every circumstance, not blanket or en masse.

Additionally, the secondary charges of “massive” underage pregnancy at the ranch also appear to be unfounded.

Quite simply the State of Texas prosecuted this church because it did not like their lifestyle or teachings.

If fact, much of the “evidence” that the State of Texas used to justify the “emergency removal” of the children was without merit, the Appellate Court said.

Looking to the future, one can only wonder how much the lawyers for the Yearning For Zion ranch will ask for in punitive damages against the State of Texas. This could turn into one of the biggest religious and civil right abuse cases to come about in a long time. I will endeavor to keep you posted on the constitutional arguments as time merits.

In the meantime, lets hope the children will be reunited with their parents quickly.

Democratic Party Vote Hypocrisy

 

Doesn’t anyone remember the year 2000? Doesn’t anyone out there remember the Democrats furious with anger that the popular vote had not elected the President?

My O my how the times have changed.

More proof that the ideals the Democratic party claims to espouse are only borne out of political necessity: whatever is necessary at the moment to make the Republican party look bad.

By refusing to seat the delegates from Florida and Michigan, the Democratic party is guilty of its own hypocrisy. A chart showing Hillary with the popular vote lead when Florida and Michigan are counted can be found here. 

Another interesting point: had EVERY vote counted (i.e. the overseas absentee ballots in Florida) Bush would have easily won the popular vote. At least the Democrats are consistent with their own inconsistency.

But then again, it’s no wonder that the Democrats are running from the “let the popular vote count” manta. Check out the most recent J. Sidney McCain vs. B. Hussein Obama polling results. McCain wins. You can be damn sure the Dems will not want the popular vote to count then!

Of this you can be sure: The questions of Barack’s association with the Rev. Wright have only served to weaken his national character. Should Mr. Obama win the nomination, McCain should start polling more consistent with Barack. The Democrats, always seeking to establish a new “minority of legitimacy” will use whatever legal or shady tactics possible, selectively across the states, to produce election results in their favor.

No wonder Obama won Oregon so easily, Oregon has an all absentee ballot system.

No wonder Democrats so furiously fight voter-ID laws

Isn’t progress great? You follow the law, and they undermine you for their intended result!

The GOP fundraising woes catch up with McCain

McCain to rely on party money against B. Hussein

Perhaps all those “moderates” or “independents” will fork over their money to McCain? Perhaps all those non-Republican’s will give up their money? After all, election results like these did not come from conservative voters. One thing is for certain: most conservatives will not give this man a dime, no matter how much trouble he is in.  If the GOP is going to exclusively work for the McCain brand now I predict that the fund raising woes on the Republicans part will only continue.

Don’t get me wrong. McCain is the Republican nominee, so I will vote for him. But give MY hard earned cash to an amnesty supporter? Give my hard earned cash to someone who will continue the flow of jobs overseas? Give my hard earned cash to someone who will not tow the party line? Yeah, I don’t think so.

eLECTION FRAUD

Put this in the, “It completely obvious you don’t want a real public vote on this” file.

Despite the fact that Idaho’s primary is on May 27, the Nampa School District has deliberately and willfully placed a special tax election on the Tuesday night before the primary election. This was done to suppress voter turnout and skirt the Nampa School districts responsibility to the voters.

Taxing elections should be held on the primary or general election night. Admittedly, this is not always possible. Conservatives in Idaho have been pushing for years to establish 4 nights a year (quarterly) that the taxing entities could place bond or other special elections on. Additionally, the election would be held at your regular polling place, not at the taxing districts office itself. This removes the ability of say the school boards to “pump” the elections results in their favor.

The Middleton School district also has chosen to avoid accountability by placing it school bond election outside of conventional election dates. Also, the Middleton School district blatantly lies when it says that, “your property taxes will not go up”. Well, that may be true, but renewing an existing tax is  still an important matter to consider. And one thing that Middleton residents feel for sure- that the Middleton School District is laying big plans [requiring big taxes] despite the fact that we are still paying for, and in the middle of, rebuilding the High School.

Idaho needs to strengthen is special property tax bond election laws to provide some measure of real accountability and openness.


UPDATE 5-20-2008The Caldwell School District is also among the list of schools holding their tax elections on Tuesday.

Ignoring the law: Canyon County taxes without authority

It is a pattern that we have seen time and time again in Idaho. Local governments, cities and at times even the state itself will hold a special election to put a tax vote before the people. Then, when the citizens deny the reach of government into their pocketbooks, the government proceeds forward with the project and taxes the citizens anyway.

Such is the case with the “temporary” Canyon County holding facility.

Lets be perfectly honest, there is nothing “temporary” about a facility that has to be built with certain federal safety, inmate security and housing standards in mind. Simply adding the word “temporary” in front of this real property does not discount the brick, mortar, lockdown mechanisms, medical facilities, holding cells and security monitoring systems that are in place.

Canyon County seems to think that simply not calling a tax a tax, or a building a building, will somehow get them off the hook for their legal responsibility to go before the voters before entering into long-term debt for the county.

Government does not know better than the people. The reason Canyon County has a jail problem is because of the lack of the local drug-rehabilitation facility. 85% of all crimes are committed by someone whose life has been touched by drugs or alcohol. And yet, we are not taking the most simplest steps to eradicate the cycle of recidivism crime. I would argue the county has a moral obligation to develop strong anti-drug and drug rehabilitation facilities before it seeks to incarcerate more people for petty crimes.

There are also people in prison who shouldn’t be there. People arrested for having messy yards. People arrested for having to many animals on their property. People who simply cannot make restitution through no fault of their own. Non-trafficking drugs crimes need intervention, rehabilitation and restitution. Our prisons are over crowded precisely because we are not helping people stop the cycle of recidivism.

Canyon County has also refused to look at alternative sentencing, community labor. There are plenty of areas in Canyon County that could use graffiti painted over, weeds pulled, fences repaired and trash picked up. You couple community service with a strong anti-drug abuse program and you are essentially ending the culture of acceptance- by engaging the community to overcome the social norms that put individuals in that position in the first place.

But, as it stands, we will get none of that. No need for rehab. No need to stop the cycle of violence tearing families apart. Nope, just force more taxes, more government, more regulations down the people’s throat.

Isn’t it nice to know that our government is effective, efficient and responsive to our demands?
