Senate To Take Up Bill Ending Mandatory Arbitration Agreements

Finally some action will get taken on an issue long overdue.

This week the Senate will take up hearings on S. 1782 The Arbitration Fairness Act of 2008. I strongly encourage you to write your representatives in support of this legislation aimed at ending predatory and one-sided dispute mediations.

Quite simply, mandatory arbitration agreements violate your constitutional rights, deny you a fair opportunity to assert your claims and ensure that fairness is instituted in the facilities serving as a judge and jury.

Let me be clear: I have no problem with non-binding arbitration. But a companies hand selected arbitration firm should not be allowed to act as the courtroom from disputes that arise. Nearly all arbitration contract provisions dictate a companies hand-selected arbitration. That arbitration is of course well compensated for its services. The companies are essentially buying a private courtroom. This is unacceptable.

Mandatory Binding Arbitration violates the essential principals of American civil government. We cannot allow binding arbitration agreements to circumvent the court system where the rule of law and legal rights can be protected. The slow creep toward fascism would try to move people away from public courtrooms and open procedures.

How easy would it be for the government, whom is already bailing out the airlines, mortgage industry, etc… to cozy up to businesses to make sure you cannot enforce your constitutional rights? If you don’t take action now, very soon that will become reality.
